Pool Rules and Safety Practices

 
 

With summer almost here and pool season fast approaching, swimming pools will soon be open for use by Owners and residents alike. Below are a few reminders regarding actions needed to minimize Associations’ liabilities when it relates to pools.


Pool Rules:

We recommend that pool rules be adopted and mailed or emailed to all Owners and residents. If the Board of Directors isn’t clear on the legalities of certain rules such as adult swim times or unaccompanied children in the pool area, please ensure to obtain the Association attorney’s legal advice as pool rules can at times produce liability if not properly worded or if illegal rules are enacted.

 

Pool Signage:

We strongly recommend that signage be installed at the pool in a conspicuous location or multiple locations if the pool is large, with the pool rules and any other important information so that all Owners, residents, and their guests may read and be aware of the pool rules.

 
 

Pool Safety Equipment:

As part of the pool season start up, please ensure that all the pool safety equipment that may be needed in the regular course of operating the pool is operational and in good condition. This responsibility can be added to the responsibilities of the pool contractor, and if not in the contract, please ensure to ask the pool contractor in writing to check and confirm that all pool equipment and pool safety equipment is operational and in good condition.

Pool Access:

If your pool is accessible via a key or fob system, please remember that an Owner’s access to the pool may be suspended if the Owner is delinquent or not in good standing with the Association if the Association’s Declaration or adopted Covenant Control and/or Collection Policy allow for the suspension of such rights. Please ensure to contact the Association’s attorney prior to this action to confirm that all steps are properly taken related to the suspension of an Owner’s use of common elements if the Owner is not in good standing with the Association.
